Waiver of Liability and Risk

By participating in a Walk and Talk session (the Activity) with OLIVIA COZZOLINO : Impact Practice (the Guide), you acknowledge that you will be participating in an outdoor activity that is potentially dangerous. The waiver of liability is an Agreement that attendance at an Activity is strictly voluntary and of your own choice and that you agree 100% to accept personal responsibility for all and any foreseen and unforeseen events that may occur during, including to and from the Activity.

You understand that during your participation in the Activity, you may be exposed to a variety of hazards and risks, foreseen or unforeseen, which are inherent in each Activity and cannot be eliminated without destroying the unique character of the Activity. These inherent risks include, but are not limited to, the dangers of serious personal injury, property damage, and death (“Injuries and Damages”) from exposure to the hazards of outdoor activities and travel to and from these activities. While it is rare, when walking in the natural environment in Australia some of the risks may include, but are not limited to, trips, slips and falls on uneven, obstructed, or slippery terrain; being struck by a falling branch or tree; bites or stings from snakes, spiders or other insects.

OLIVIA COZZOLINO : Impact Practice and its organisers take no responsibility for you and will not be held responsible for any injuries or accidents that may occur during the Activity. Outdoor activities are inherently dangerous and accidents will happen and that risks of such Injuries and Damages are a part of outdoor activities. You appreciate that you may have to exercise extra care for your own person and for others around you in the face of such hazards.

In consideration for your acceptance as a participant in an Activity, you confirm your understanding that:

OLIVIA COZZOLINO : Impact Practice does not certify or confirm the qualifications of any of the organisers to respond during an emergency by providing first aid, CPR, or any rescue action. You further understand that on an Activity there may not be medical facilities or expertise necessary to deal with the Injuries and Damages to which you may be exposed.

The Activity officially begins and ends at the location(s) designated by OLIVIA COZZOLINO : Impact Practice. The Activity does not include carpooling, transportation, or transit to and from the Activity, and you are personally responsible for all risks associated with this travel.

If you decide to leave early and not to complete the Activity as planned, you assume all risks inherent in your decision to leave and waive all liability against OLIVIA COZZOLINO : Impact Practice arising from that decision.

Walking in the outdoors is a physical activity that can involve varying levels of physical exertion. Participants must be in good general health, free from cardiovascular and respiratory disease, and have good exercise tolerance. It is your responsibility to be aware of the fitness level required for the Activity. When in doubt, please call and discuss it with the Guide, and/or obtain medical approval before commencing such Activity. You must inform the Guide before the start of the walk of medical conditions, illnesses or disorders that may be relevant for safety reasons or aggravated during the activity.

To the fullest extent allowed by law, you agree to waive, discharge claims, and release from liability OLIVIA COZZOLINO : Impact Practice, its officers, directors, organisers, assistant organisers, employees, agents, and leaders from any and all liability on account of, or in any way resulting from Injuries and Damages, even if caused by negligence of OLIVIA COZZOLINO : Impact Practice, its officers, directors, organisers, assistant organisers, employees, agents, and leaders, in any way connected with this Activity.

You further agree to hold harmless OLIVIA COZZOLINO : Impact Practice, its officers, directors, organisers, assistant organisers, employees, agents, and leaders from any claims, damages, injuries or losses caused by my own negligence while a participant on the Activity. You understand and intend that this assumption of risk and release is binding upon your heirs, executors, administrators and assigns, and includes any minors accompanying you on the Activity.

This Agreement is intended to be as broad and inclusive as is permitted by law. If any provision or any part of any provision of this Agreement is held to be invalid or legally unenforceable for any reason, the remainder of this Agreement shall not be affected thereby and shall remain valid and fully enforceable.

By participating you freely and voluntarily assume all risks of such Injuries and Damages.

“Claims” includes but is not limited to any and all liabilities, claims, demands, legal actions or rights of actions for damages, financial or economic loss, or loss or damage to or loss of your property incurred or suffered by you directly or indirectly as a result, in whole or in part from your participation in the Activity.

The Guide reserves the right to refuse any participant the right to commence or require the participant to cease participation in the Activity should they believe it necessary on medical grounds.

By participating in the Activity and you agree and acknowledge that:

(a) the Activity may be physically strenuous;

(b) You are in proper physical condition to participate in the Activity;

(c) You are aware that participation could, in some circumstances, result in physical injury, serious physical injury or death; and

(d) You understand your physical limitations and are sufficiently aware of those limitations to stop physical activity before you become ill or injured and will do so.
